WHAT IT IS AND WHY IT MATTERS BEFORE BUILDING
A Prior Information Request (Pedido de Informação Prévia – PIP) is an optional administrative procedure in Portugal that allows anyone to obtain official clarification from a municipality regarding the feasibility of a specific urban planning operation or a set of related operations intended for a property.
In practical terms, a PIP for construction functions as a preliminary viability assessment issued by the municipality before initiating formal procedures such as:
Building licensing
Prior communication (Comunicação Prévia)
Urban subdivision operations
Construction, alteration, extension, demolition, or conservation works
One of the key advantages of a PIP is that, if the decision is favourable, it creates a binding commitment for the municipality, provided the project submitted later remains unchanged and is submitted within the legal validity period of two years.
Under certain circumstances — particularly when a qualified PIP is submitted — the operation may even become exempt from prior municipal control, as provided in Article 14(2) of the RJUE (Legal Framework for Urbanization and Building).
LEGAL FRAMEWORK AND DECISION DEADLINES
The Prior Information Request is regulated by the Regime Jurídico da Urbanização e da Edificação (RJUE).
According to Article 16(1) of the RJUE, the municipality must issue a decision within:
20 working days for standard PIP requests (Article 14(1))
30 working days for qualified PIP requests (Article 14(2))
The applicable deadline depends on:
The level of detail submitted
The type of information requested
The complexity of the proposed urban planning operation

WHAT CAN BE DETERMINED THROUGH A PRIOR INFORMATION REQUEST?
Submitting a PIP allows applicants to understand key aspects related to the development potential of a property.
Through this procedure, it is possible to determine:
- Whether construction or development is feasible
- Applicable legal or regulatory constraints
- Required infrastructure connections

WHO CAN REQUEST A PRIOR INFORMATION REQUEST ?
One of the advantages of this mechanism is that any interested party can submit a PIP, even if they are not yet the owner of the property.
This makes the procedure particularly valuable for:

- Architects evaluating development potential
By requesting a PIP, an interested party can obtain official confirmation of the development possibilities of a site before purchasing or investing.
QUALIFIED PRIOR INFORMATION REQUEST: WHEN MORE DETAIL IS SUBMITTED
When the applicant submits a more detailed proposal, including architectural information, the municipality may issue what is commonly called a qualified PIP under Article 14(2) of the RJUE.
In this case, the request may address specific aspects such as:
- Building volume and height
- Architectural layout and positioning
- Intended building use and construction area
- Infrastructure connections
- Urban planning charges
- Public land allocation requirements
A qualified favorable PIP decision can be particularly powerful, as it binds the municipality to the approved parameters, provided the later project respects the approved conditions.

TWO-YEAR LEGAL PROTECTION
A favorable decision remains valid for two years, allowing applicants to prepare the subsequent licensing or prior notification procedure with greater security.

A favorable PIP also provides a legal guarantee, since the municipality is bound by its decision when assessing future procedures.
This reduces the risk of:

POSSIBLE EXEMPTION FROM PRIOR CONTROL
If the PIP is submitted with sufficient detail and approved under Article 14(2), the urban planning operation may become exempt from prior municipal control, depending on the circumstances.
FASTER SUBSEQUENT PROCEDURES
If a project follows the parameters defined in a favorable PIP:
- External authorities that already issued opinions do not need to be consulted again
- Licensing or prior notification procedures can be significantly faster
HOW TO SUBMIT A PRIOR INFORMATION REQUEST
A Prior Information Request must be submitted to the relevant municipal council (Câmara Municipal) through a specific application form.
The application generally requires:
- Applicant identification
- Property identification
- Land registry certificate
- Identification of the property owner
- Description of the proposed urban planning operation
- Specific aspects for which clarification is requested
- Supporting documents according to the type of operation
The application is also subject to municipal fees, defined in each municipality's urban planning fee regulations.
WHEN SHOULD YOU CONSIDER SUBMITTING A PIP?
A Prior Information Request is particularly useful in situations such as:
- Land that is not part of an approved subdivision
- Projects involving significant alterations or new construction
- Real estate investment analysis
- Early-stage architectural feasibility studies
By clarifying planning conditions early, a PIP can significantly reduce risk and accelerate the path to construction.

HOW LONG IS A PIP VALID?
A favorable PIP decision is valid for two years. After this period, it may be renewed, provided that there are no changes to the factual or legal assumptions, upon request to the Municipal Council.
CAN SOMEONE REQUEST A PRIOR INFORMATION REQUEST WITHOUT OWNING THE PROPERTY?
Yes. Any interested party can submit a Prior Information Request, although the property owner must be identified.
DOES A PRIOR INFORMATION REQUEST ALLOW CONSTRUCTION TO START?
Yes and no. A PIP (1) only provides binding information about feasibility and conditions. Construction still requires licensing, prior communication, or exemption depending on the case. However a PIP (2) gives the permit to build, therefore further documentation needs to be submitted in the process, but in the architectural point of view grant construction.
CAN A FAVORABLE PRIOR INFORMATION REQUEST MAKE CONSTRUCTION EXEMPT FROM LICENSING?
In certain cases, yes — particularly when a qualified PIP is approved under Article 14(2) of the RJUE, following the reforms introduced by Decree-Law 10/2024.
